When the Internet user chooses several methods from home delivery and Click & Collect, they receive different emails and/or SMS messages, as these are distinct orders with their own conditions.
JOE BIKE informs the Internet user that the shop manages its own stock and is the sole decision-maker for validating or cancelling an Internet user's order due to the unavailability of the ordered product(s).
Home Delivery: The home delivery service is available in mainland France. Upon confirmation of the order, the ordered products are prepared and handed over to the carrier, subject to availability, within 5 working days. For pre-ordered products (not immediately available, with the date indicated on the website) they will be prepared and handed over to the carrier within 5 working days of the date indicated on the website at the time of order. Once the order has been dispatched, the customer will be informed by e-mail or telephone (at the number provided during the order).
For home delivery of bicycles, the carrier will contact the User directly to arrange an appointment. In the event of the User's absence at the agreed time slot, the carrier will contact them by email and telephone to schedule a new appointment.
In the event of a delivery delay, beyond the timeframe specified at the time of contract conclusion, the Internet user must contact JOE BIKE customer service by telephone, email or post at the contact details indicated on the Website, in order to request that delivery be made within a reasonable additional timeframe, or that the order be cancelled.
In the event of cancellation, the Internet user will be refunded the full amount paid, including delivery charges, within 14 days.
Products shall be delivered by the carrier to the delivery address indicated when ordering on the Website.
If the user wishes to have deliveries made to multiple delivery locations, they must place multiple orders; delivery charges for each order will be payable.
In the event of exceptional stockouts, JOE BIKE will inform the Internet user, as soon as possible, by email. The Internet user may choose a partial delivery of the available product(s) with a refund of the purchase price of the undelivered product(s) or request a total cancellation and a refund of their entire order, including delivery costs.
Delivery transfers ownership and risk of the order to the Internet user.
Regarding the receipt of parcels, JOE BIKE strongly recommends that the Internet user check the apparent condition of the products upon delivery of their parcel by the carrier (such as crushed, deformed, torn or stained parcels, for example). JOE BIKE also recommends keeping the original packaging of the products before the products are put into service and used for the first time, particularly concerning bicycles, allowing, if necessary, the return of the products by carrier to the JOE BIKE store.
The customer must express any reservations on the carrier's delivery slip or receipt and inform JOE BIKE within 3 days of receiving the product(s).

Orders placed on the Site may be modified according to product availability, which can vary between order confirmation and validation.
JOE BIKE will inform the internet user by email of the product(s) that have become unavailable at the time of validation of the order by the chosen pick-up store.
Unavailability shall result in the cancellation of the product(s) concerned.
Once the order has been registered on the Site, the Internet user will receive an order confirmation email.
The User's bank account is debited at the time of the order. Receipt of delivery transfers ownership to the User.
If the entire order is unavailable, the Internet user will receive an email informing them that it has been cancelled by the chosen shop. In the event of cancellation, the Internet user will be refunded all sums paid, including delivery charges, within 14 days.
Any product used by the Internet user is no longer a new product, and as such, is not eligible for return or refund.
Conditions for exercising the right of withdrawal: In accordance with current legal provisions, the Internet user who places an order (Click & Collect, Home Delivery) via the Site has a right of withdrawal, without needing to provide a reason, within 14 calendar days from the day after the date of receipt or collection of the order by the Internet user or a third party designated by them other than the carrier.
If the withdrawal period expires on a Saturday, Sunday or public holiday, the period shall be extended until the next working day.
This timeframe is deemed to have been met if the internet user returns the order before the expiry of the 14-day period.
Under Article L. 221-28 of the Consumer Code, certain products are excluded from the right of withdrawal:
Products that have been unsealed by the Internet user and cannot be returned for reasons of hygiene or health protection. For example (and without this list being exhaustive): underwear...;
Products falling into the category of Personal Protective Equipment (PPE). For example, (and this list is not exhaustive): bicycle helmets, etc...; ;
Products made to the Internet user's specifications, or clearly personalised. ;
Perishable products, such as food products
How to exercise the right of withdrawal: To exercise their right of withdrawal, the Internet user must notify JOE BIKE of their decision to withdraw by means of an unambiguous statement:

Click & Collect order: The customer may return their order to the JOE BIKE store where they collected their equipment no later than 14 days after informing us of their decision to withdraw.
Home delivery order: The customer will be contacted by JOE BIKE customer service via email, who will inform them of the return procedure according to the products to be returned. Return costs are the responsibility of the customer.
Effects of exercising the right of withdrawal: JOE BIKE systematically checks the general condition and functionality of returned products, regardless of the delivery method, before proceeding with a refund.
JOE BIKE reserves the right to refuse the refund of any product sold as new which is not returned as new, which has been used, or is scratched, damaged, soiled, etc., showing signs of use beyond what is necessary to establish the nature, characteristics and proper functioning of the product, incompatible with testing the product, rendering the product unfit for resale.
JOE BIKE reserves the right to refuse a refund for any used product that has been used, is damaged, stained, etc., showing signs of use beyond what is necessary to establish the nature, characteristics and proper functioning of the product, preventing the product from being tested, and making the product unfit for resale.
Any Personal Protective Equipment (PPE), such as a bicycle helmet, excluded from the right of withdrawal, is not eligible for return and refund.
The Customer must return the new or used product(s) with the accessories and instructions supplied, if possible in their original packaging, failing that, in suitable packaging that properly protects the returned product(s).
JOE BIKE will refund the Internet user in full for any sums paid, if the order is returned in its entirety, within a maximum of 14 days from receipt of the new product(s), subject to the condition of the product.
The order registered by the Internet user may be subject to several shipments, meaning several separate parcels.
The customer who returns their entire order, consisting of one or more shipments, will be refunded the full amount of their order, including the initial delivery charges. The cost of return shipping will be borne by the customer.
If the customer returns part of their order, i.e. one of the two shipments making up their order, they will be refunded the full amount of the returned products, including the initial delivery costs. The cost of returning the goods will be borne by the customer.
In the case of a return of a product purchased on promotion, JOE BIKE will refund the product at the reduced price in effect on the day of the order paid for by the Internet user, and not at the price of the product outside of the promotion.
All returned products remain the exclusive property of JOE BIKE.
JOE BIKE will process the refund by crediting the bank account used for the order, unless the User expressly requests an alternative refund method.
If a refund proves impossible, for example due to theft or fraud of the bank card used, the Internet user must contact Customer Service. For security reasons, Customer Service will ask the Internet user to explain and justify the reason making a refund to the bank account used for the order impossible, and will proceed with identity verification. In case of serious doubt, JOE BIKE reserves the right to refuse a refund to a bank account other than the one used for the order.
The foregoing in no way precludes the application of legal warranties where the conditions are met (See Article 12 - Warranties).
