Any product used by the User is no longer considered new and, as such, is not eligible for return or refund. Conditions for exercising the right of withdrawal: In accordance with the legal provisions in force, a User who places an order (Click & Collect, Home Delivery) via the Website has a right of withdrawal, without having to give a reason, within 14 calendar days from the day after the date of receipt or collection of the order by the User or a third party designated by them other than the carrier. If the withdrawal period expires on a Saturday, Sunday, public holiday or non-working day, the period is extended until the next working day. This period is deemed to have been met if the User returns the order before the expiry of the 14-day period. Under Article L. 221-28 of the Consumer Code, certain products are excluded from the right of withdrawal: Products that have been unsealed by the User and cannot be returned for reasons of hygiene or health protection. For example (and without this list being exhaustive): underwear…; Products falling within the category of Personal Protective Equipment (PPE). For example (and without this list being exhaustive): cycling helmets, etc.; Products made to the User’s specifications, or significantly personalised; Perishable goods, such as food products; Procedures for exercising the right of withdrawal: To exercise their right of withdrawal, the User must notify JOE BIKE of their decision to withdraw by means of an unambiguous statement: By post with acknowledgement of receipt, to the following address: Customer Services – JOE BIKE, 119 avenue des Tisserands, 40150 Soorts-Hossegor By email to the following address: contact@joebike.fr Click & Collect orders: The Customer may return their order to the JOE BIKE shop from which they collected their goods, no later than 14 days after notifying their decision to withdraw. Home-delivered orders: The Customer will be contacted by JOE BIKE’s customer service team via email, which will explain the returns procedure depending on the products to be returned. Return costs are payable by the customer. Consequences of exercising the right of withdrawal: JOE BIKE systematically checks the general condition and functionality of returned products, regardless of the delivery method, before processing a refund. JOE BIKE reserves the right to refuse a refund for any product sold as new that is not returned in new condition, that has been used, or that is damaged, soiled, etc., shows signs of use exceeding what is necessary to establish the nature, characteristics and proper functioning of the product, is incompatible with testing the product, or renders the product unsuitable for resale. JOE BIKE reserves the right to refuse a refund for any second-hand product that has been used, whether it is worn, damaged, soiled, etc., showing signs of use beyond what is necessary to establish the nature, characteristics and proper functioning of the product, incompatible with testing the product, rendering the product unsuitable for resale. Any Personal Protective Equipment (PPE), such as a cycling helmet, which is excluded from the right of withdrawal, is not eligible for return or refund. The Customer must return the new or second-hand product(s) together with the accessories and instructions supplied with them, if possible in their original packaging, or failing that, in suitable packaging that adequately protects the returned product(s)(s). JOE BIKE will refund the User the full amount paid, provided the order is returned in its entirety, within a maximum of 14 days from receipt of the new product(s), subject to the condition of the product. An order placed by the Customer may be dispatched in several shipments, i.e. in several separate parcels. A Customer who returns their entire order, comprising one or more shipments, will be refunded the full amount of their order, including the original delivery charges. The cost of returning the goods is the Customer’s responsibility. A User who returns part of their order – that is, one of the two consignments making up their order – will be refunded the cost of the returned products, including the original delivery charges. The cost of returning the goods is borne by the User. In the event of a return of a product purchased on promotion, JOE BIKE will refund the product at the discounted price in force on the day the order was paid for by the customer, and not at the non-promotional price of the product. Any returned product remains the exclusive property of JOE BIKE. JOE BIKE will process the refund by crediting the bank account used at the time of the order, unless the customer expressly requests another method of refund. If a refund proves impossible, for example due to theft or fraud involving the bank card used, the User must contact Customer Services. For security reasons, Customer Services will ask the User to explain and provide evidence of the reason why a refund to the bank account used when placing the order is not possible, and will verify their identity. In the event of serious doubt, JOE BIKE reserves the right to refuse a refund to a bank account other than the one used for the order. The foregoing shall in no way prevent the application of statutory guarantees where the conditions are met (see Article 12 – Guarantees).
